Your town can fight a cell tower on looks. Not on health.

A carrier picks the spot. Neighbors object. The town holds a hearing, and someone stands up to talk about the children in the school across the street. Then a lawyer explains that under Section 704 of the Telecommunications Act of 1996, health is not something the town is allowed to consider. Courts have gone further and read federal law to shield carriers from liability for the harm they cause. That is why the infrastructure has kept going up for thirty years, right outside bedroom windows, with almost nothing standing in its way.

How the law got this way, and what moves it.

Camilla has worked on EMF policy for almost twenty years. Scott has litigated telecom law for forty, and in 2021 he took the FCC to court over its radiation exposure guidelines and won. Together they walk through the two problems at the root of all of it, and the campaign built to fix them.

What Section 704 Actually Says

The language that bars state and local governments from regulating towers on health or environmental grounds, how it got into the Act, and whether the Congress that passed it understood what it was doing.

Why the FCC Limits Do Not Protect You

Something is finally moving

After thirty years of almost nothing, several things shifted this year.

HHS Wants to Hear From You
On September 20, 2026, the Department of Health and Human Services issued a formal Request for Information, asking scientists, clinicians, parents and the public about the biological and health effects of electromagnetic fields. Comments close October 21.
The FCC Is Under Court Order
In August 2026 the D.C. Court of Appeals gave the FCC 30 days to explain why, five years after the 2021 ruling, it still had not answered the court on why its radiation exposure guidelines remain unchanged.
A Preemption Bill Got Pulled
In April, after MAHA Action urged the House to oppose H.R. 2289, legislation that would strip local control over antenna infrastructure, the bill was pulled from floor consideration.
And the Pressure Is Still Coming
New FCC rules are proposed to further limit local authority, and the FCC wants to change NEPA requirements so antennas can go up faster with less review. This is why the window matters.
